How would you draft the following: Wills for a married couple, residuary estate passes outright to the surviving spouse unless the survivor is receiving government benefits then they would like it to go into an SNT for their benefit. No disclaimer trust option and all other bequests go to the beneficiaries outright.
We do not have an option in the program for a contingent SNT for beneficiaries (spouse or non-spouse) when the underlying gift is outright.
